Gross v. TJH Automotice 380 N.J.Super 176 (App.Div 2005)

In Gross v. Cherry Hill Classics, the Appellate Division held that a dealership is permitted to charge various documentary and messenger fees so long as they are properly itemized and disclosed to a consumer in a transaction. In this case, the plaintiffs filed a class action against the dealer claiming that the charges for messenger’s documentary service were excessive in violation of industry standards and could not be charged. The Appellate Division disagreed and determined that a dealership could make such charges assuming they were properly disclosed and itemized consistent with the regulations.
